Abstract
:
The study concentrates on the rules governing the employees inventions to find out the extent of their eligibility in the invention that they come up with during their work. This study has been done by adopting the analytical and the comparative methods for the provisions of the Saudi law, Gulf patent system and visual law in order to analayze the texts related to the study and state the similarities and differences between them. The study was divided into three researches, The introductory research deals with elements of the worker's invention followed by the research dealing with the types of inventions. The study has concluded with many results. The most important one is that the system regulations under study agreed on the necessity of transferring the financial rights, arising from service inventions, to the business owner. The accidental inventions, Saudi regulater didn't manage in achieving balance between the employer rights and the inventor worker. In this case, the ownership of the invention reverts to the employer if the worker invention is created only by the means and capabilities of the establishaet where he works. On the contrary, the Egyptian Law has managed in creating this balance between the two parties of the work contract, It has granted the employee the right to apply for a patent. More oner, It has also granted the employer the choice between exploitating the invention or baying it for fair compensation. This compensation is provided that the employer should make a decision within a maximum period of three months starting from the date of issuing a patent by the employee.
