This study discusses the prevention of labor risks and their provisions in the Saudi labour law, which is one of the most important aspects of regulating the labor relationship as it aims to protect the worker and his or her employer from potential risks and consequences, The study therefore sought to demonstrate the content of work risk prevention by presenting what it is and its importance and demonstrating the difference between it and occupational safety and health. and aimed at mentioning and limiting the types of potential hazards in the working environment, In addition to the statement of the labour risk prevention provisions of the labour relationship parties' obligations Employers, enterprises and workers in the establishment, and indicate the effects of the parties' lack of commitment to the prevention of labour risks; The study methodology is based on the analysis, description and criticism of the articles on the prevention of labour risks in the Saudi labour system and all the provisions and obligations thereon contained in various independent ministerial decisions for the purpose of their accounting and improvement The study found several findings, the most important of which was that the Saudi regulator did not know about the prevention of work risks and did not mention the types of potential risks in the working environment except for behavioural infringements in an independent ministerial decision. In addition, labour risk prevention provisions are differentiated from those contained in the Labour Regulations, inter alia, in various ministerial decisions, which result in the likelihood that workers' relationship parties are not familiar with and committed to them and increase the incidence of risks in the working environment; The study therefore recommended to the Saudi regulator the issuance of a working risk prevention regulation according to the Saudi labour system and its scope of application, which includes definitions, scope of application, types of potential risks in the working environment and provisions for prevention, taking into account the amendments outlined and proposed in this study. |
