Abstract : This study talked about international responsibility for damages resulting from the use of nuclear energy for peaceful purpose, we have studied the Atom concept from philosophers until human could use its energy, and how international community has been trying to get benefits from its to contribute of develop of live quality. Also, how is IAEA played a pivotal role to control the peaceful using of nuclear energy, and how this agency has access to imposing control and supervision with countries which contracts with it, for sharing updates information in this science. Despite of the economic benefits of nuclear energy, a lot of international community and organizations reserve about it, because some painful accidents by it, these accidents made the international law to find out a new theory about international responsibility in these accidents, and reparation any one damaged. The mistake theory will not work on this field, because the special situation of nuclear damage is very difficult to approve the mistake on countries which causing of nuclear damages, and the risk theory is the best way to compensate for the damages arising therefrom.
