Abstract |

The thesis included an introduction, preamble, five chapters and a conclusion.
• Introduction: tackles the research problem, the research objectives, the importance of the topic, the previous studies, the approach and structure of the search.
• Preamble: contains a brief about the author, his race, his students, his sheikhs, the praise of his scholars, his death, the definition of custom, the argument of custom, the position of custom and how custom affects worships.
• Chapter One: Book of Pureness, and it tackles five topics: The first: pure water that does not deodorize. The Second: Utensils. The third: the appearance of blood. The fourth: When woman menstruates. The fifth: Puerperium
• Second Chapter: Book of Prayer, and it tackles five topics: The first: the call to prayer (Azan) and the Iqamah. The second: Prostration for forgetfulness. The third: The Provisions of emulation. The fourth: The conditions for the validity of prayer. The fifth: Lifting the grave off the ground.
• Chapter Three: The Book of Zakat. It contains three topics: The first: Zakat on the grazing livestock. The second: The mixture. The third: Provision of obligatory zakat.
• Chapter Four: The Book of Fasting, which includes one topic: The first topic: What breaks the fast
• Chapter Five: The Book of Hajj. And it tackles four topics: The first: The ability to perform Hajj. The second: Cutting down the plants of the Sanctuary Precincts. The third: Entering Makkah and Rounds of Tawaf and Sa'i. The fourth: Camel’s slaughter.
• Conclusion: It includes the custom controls, results and recommendations.
The most prominent conclusions reached by the researcher are as follows:
• Custom is one of the reasons for changing fatwa to change the conditions and norms of people.
• The deep interest of the doctrines of Jurisprudence in custom, as they set rules and controls for the same, as custom occupies a high position in Law, and its importance lies on what follows:
- The acknowledgment of the wise legislator of many habits and customs
- The significance of some texts derived from Qur’an and Sunnah regarding the authenticity of custom
The most prominent recommendations:
- The necessity to activate custom and the rules related thereto, as well as to be aware of the customs and habits of people.
- Establishing committees and departments in Sharia Courts and government authorities with an aim to record all the special norms in each of the areas related to custom, for reference.
