This research aims to highlight the legal and judicial aspect in the books of heritage and Islamic jurisprudence on the subject of the status of foreigners in the Islamic state compared to the Saudi regime, and the legal rooting of the regulations related to the organization of the status of foreigners in the Kingdom of Saudi Arabia, And highlighting the aspect of legislative development in the Islamic state by presenting and analyzing the systems, procedures and judicial applications, following the descriptive and applied approach based on extrapolation, analysis and conclusion.
This thesis was divided into an introduction, a preface, five chapters, a conclusion, and indexes.
As for the introduction, it included the problem of the research, its questions, its objectives, its importance, previous studies, the method used, the limits of the research, and the structure of the research.
As for the introduction, it included three topics: the first topic: what is meant by private international law, its importance and the scope of its topics, the second topic: the nature and sources of private international law, and the third topic: applications of the provisions of private international law in the Islamic jurisprudential heritage and the Saudi legislative system.
As for the first chapter, it was devoted to the nature of a foreigner in jurisprudence and the Saudi system, and it included three investigations. Then the third chapter deals with the general rights and freedoms of foreigners in jurisprudence and the Saudi system and its judicial applications, and it contains four topics. and its judicial applications, in which there are three topics.
Then the conclusion: and it contains the most important results, including: that the term citizenship is an original term in Islam, and its first lights radiated from the constitution of Medina and the subsequent books and covenants of the Prophet of God Muhammad, may God’s prayers and peace be upon him, in which he defines the relationship between Muslims and non-Muslims, and that the foreigner is in the Saudi system And Islamic jurisprudence is those who do not hold the nationality of the state.
